Haryana Civil Services (Leave) Rules, 2016: Definitions of Key Leave Types

The Haryana Civil Services (Leave) Rules, 2016 provide detailed definitions for various types of leave applicable to government employees. Below are the important types of leave and their definitions:

1. Casual Leave

  • Definition: Leave granted to a government employee for unforeseen or occasional unauthorized absence. While on casual leave, the employee is treated as on duty for all purposes, provided it is sanctioned by the competent authority.

2. Child Adoption Leave

  • Definition: Leave granted to a female government employee upon the legal adoption of a child.

3. Child Care Leave

  • Definition: Leave granted to a female government employee for a maximum of two years (730 days) during her service for the care of her two eldest surviving children, up to the age of 18 years.

4. Commuted Leave

  • Definition: Leave granted in exchange for half-pay leave, typically for medical reasons or pursuing higher technical or scientific studies in the public interest. Double the amount of commuted leave is debited from the half-pay leave account.

5. Competent Medical Authority

  • Definition: A physician not below the rank of a medical officer in a government hospital, dispensary, or a private hospital approved by the Haryana Government. It also includes Ayurvedic, Unani, and Homoeopathic medical practitioners in government hospitals, dispensaries, and approved private hospitals.

6. Completed Year of Service (Half Pay Leave)

  • Definition: Continuous service of a specified duration, including periods of service treated as duty, leave, and extraordinary leave, qualifies an employee for half-pay leave.

7. Earned Leave

  • Definition: Leave earned by a government employee in respect of the period spent on duty.

8. Emoluments for Leave Encashment

  • Definition: The components of basic pay that are considered when calculating leave encashment, which include:
    • Basic Pay (actual or notional)
    • Dearness Allowance on basic pay
    • Special Pay (in lieu of higher time scales)
    • Personal Pay (if applicable)
    • Non-Practicing Allowance for Doctors and Veterinary Surgeons (subject to limits)

9. Extraordinary Leave

  • Definition: Leave during which no leave salary is payable, except house rent allowance for the first 180 days of the leave period.

10. Half Pay Leave

  • Definition: Leave earned for a completed year of service, admissible to government employees working on a regular basis.

11. Head of Mission

  • Definition: The title for high-ranking diplomats, including Ambassador, Charge d’Affaires, Minister, Consul-General, and High Commissioner.

12. Hospital Leave

  • Definition: Leave granted to Group C and D employees who are engaged in hazardous tasks and who incur injury or illness due to those tasks, such as handling dangerous machinery or explosive materials.

13. Leave Encashment

  • Definition: A cash payment in lieu of unutilized earned leave. This can be claimed by a government employee or the family of a deceased employee on leaving service, except in cases of dismissal or removal.

14. Leave Not Due

  • Definition: Half-pay leave granted in advance to permanent government employees when they do not have any earned or half-pay leave in their credit. It is debited to the employee’s future half-pay leave balance.

15. Leave Preparatory to Retirement

  • Definition: The last spell of earned or half-pay leave availed by a government employee before their retirement.

16. Leave Salary

  • Definition: The amount paid to a government employee in lieu of their regular pay and allowances while on leave.

17. Leave

  • Definition: Periods of authorized absence from duty, including earned leave, half-pay leave, extraordinary leave, commuted leave, maternity leave, child adoption leave, child care leave, special disability leave, study leave, etc. Note: Casual leave, special casual leave, and quarantine leave are not included.

18. Length of Service (Earned Leave)

  • Definition: Continuous service in any pay level or pay scale, including extraordinary leave, and breaks caused by retrenchment.

19. Maternity Leave

  • Definition: Leave granted to female employees for childbirth. It is admissible for six months and up to 45 days in case of miscarriage (excluding threatened abortion).

20. Quarantine Leave

  • Definition: Leave granted when a government employee or their family member contracts a prescribed infectious disease. The employee is treated as on duty during this period.

21. Special Disability Leave

  • Definition: Leave granted to employees who are disabled due to injury sustained while performing official duties or due to their official position.

22. Study Leave

  • Definition: Leave granted to a government employee for studying scientific, technical, or special courses directly related to their duties.

23. Terminal Leave

  • Definition: Earned or half-pay leave granted to an employee on the termination of their service due to post abolition.

24. Vacation

  • Definition: Periods of authorized holidays, usually considered as duty, unless otherwise specified by the competent authority. This is not classified as leave.

Any terms not explicitly defined in the leave rules, but defined in the Haryana Civil Services (General) Rules, 2016, will have the same meaning for the purpose of these leave rules.
